Introduction

Felix One Pty Ltd t/as Truth Engine (Truth Engine) values and respects the privacy of the people we deal with. Truth Engine is committed to protecting individuals’ privacy and where reasonably practicable has adopted the Australian Privacy Principles (APPs) contained in the Privacy Act 1988 (Cth) (Privacy Act). We note, however, that at the time of this Policy, Truth Engine is exempt from application of the Privacy Act. This document contains only details relating to the Personal Information Truth Engine may collect and how Truth Engine manages that Personal Information (Policy).

What is personal information?

Personal Information means any information or opinion, whether true or not, and whether recorded in a material form or not, that identifies an individual.

What personal information do we collect directly/indirectly?

The Personal Information Truth Engine collects largely depends on the nature of our dealings with customers, what customers choose to share with us and what third parties choose to share with our customers.

Without limiting the definition of Personal Information, the information we collect may include:

a. Names;

b. Addresses;

c. Email addresses; and

d. Phone numbers.

Truth Engine provides a software as a service (Software) to various organisations (i.e. our customers). When a customer of Truth Engine utilises the Software, Truth Engine receives data and collects and generates data to provide the service (including improving, securing, and updating the service), conduct our business operations, and communicate with the customer. For example, when a customer enters a job into the Software, the customer can enter its client’s names, addresses, phone numbers and other contact information.

Truth Engine also collects personal via correspondence, telephone, facsimile, from this website, from customer’s website, from media and publications, from other publicly available sources, from cookies and from third parties.

Where possible, Truth Engine will give the option to enter information into the Software or deal with us anonymously or by using a pseudonym. However, if you choose to deal with us in this way or choose not to provide Personal Information, we may not be able to provide our usual services or otherwise interact with you.

Why do we collect personal information?

Truth Engine collects Personal Information for the primary purpose of providing our services to customers. We may also use your Personal Information for secondary purposes closely related to the primary purpose, such as when providing information to our customers and marketing, in circumstances where you would reasonably expect such use or disclosure.

Disclosure of personal information

We may disclose Personal Information to third parties in accordance with this Policy in circumstances where you would reasonably expect us to disclose such information. For example, we may disclose Personal Information:

a. to our third-party service providers (for example, our external IT contractors);

b. to our professional services advisors;

c. where consent to the use or disclosure is given; and

d. where required or authorised by law.

Transfer of personal information overseas

Some of the third-party service providers we disclose Personal Information to may be based in or have servers located outside of Australia. Where we disclose your Personal Information to third parties overseas, we will take reasonable steps to ensure that data security and appropriate privacy practices are maintained.

We will only disclose to overseas third parties if:

a. you have given us your consent to disclose Personal Information to that third party;

b. the overseas recipient agrees to comply with the terms of this Policy; or

c. we reasonably believe that 1) the overseas recipient is subject to a law or binding scheme that is, overall, substantially similar to the APPs and the law or binding scheme can be enforced or 2) the disclosure is required or authorised by an Australian law or court / tribunal order.

How do we store and protect personal information?

Personal Information is stored in our secure Azure database. Truth Engine will take reasonable steps to ensure that the Personal Information that we hold about you is kept confidential and secure, including by:

a. having a robust security of our premises and databases / records; and

b. having technological measures in place (for example, anti-virus software, fire walls and multi-factor authentication).

When Personal Information is no longer needed for the purpose for which it was obtained, we will take reasonable steps to destroy or permanently de-identify your Personal Information. However, most of the Personal Information is or will be stored in client records which will be kept by us for a minimum of 7 years.

How do we store and protect personal information?

You may access the Personal Information we hold about you and to update and/or correct it, subject to certain exceptions. If you wish to access your Personal Information, please contact us in writing.

Truth Engine will not charge any fee for your access request but may charge an administrative fee for providing a copy of your Personal Information.

In order to protect your Personal Information, we may require identification from you before releasing the requested information.

This website may contain links to websites operated by third parties. If you access a third party website through our website, Personal Information may be collected by that third party website. We make no representations or warranties in relation to the privacy practices of any third party provider or website and we are not responsible for the privacy policies or the content of any third party provider or website. Third party providers / websites are responsible for informing you about their own privacy practices and we encourage you to read their privacy policies.

Updates to Privacy Policy

This Policy may change from time to time at the discretion of Truth Engine and is available upon request.
